On August, 2nd this year the President of Ukraine has signed the Law “On amendments to the Tax Code of Ukraine regarding transfer pricing”. According to the Law new mechanisms of the price definition control are being introduced in Ukraine.

The adopted Law will substantially change the format of the relationship between the pharmaceutical business and the tax authorities. In particular, the Law brings two significant innovations:

  • First, the Law expands the definition of related parties and introduces the term of "controlled operations". These transactions include those transactions exceeding in total for the year 50 million USD. and which are performed: (a) with the related party, or (b) with non-residents, having a nominal or effective rate of income tax, which is 5 percentage points lower than the tax rate in Ukraine
  • Second,
    the tax authorities are given extensive authority to determine the adequacy of the mechanism for the price determining according to certain market "standards". In particular, the tax authorities will be able to demand the disclosure of the budgeting system, marketing strategy, risks, etc.

It is quite obvious that in the initial phase of the Law in action the use of these powers will bear a distinct fiscal nature.

On the 3rd of September this year (Tuesday) from 16.00 till 18.00 Legal Alliance Company invites executives, chief financial officers, accountants and managers of pharmaceutical companies to attend the seminar “Transfer pricing in the pharmaceutical business”.

  • Comparative uncontrolled price method (similar to sales). Analysis of real examples of using the method by tax authorities
  • Methods based on the margin: the resale price method and the method of "cost-plus".
  • Methods of net profit and the net profit distribution.
  • Providing documentation on the controlled transactions.
  • Practical advice on the organization of business processes associated with pricing
  • Analysis of the various schemes of delivery of pharmaceutical products in Ukraine with the so called “ pricing risks”.

Cancellation of registration and replacement:
The participant may cancel the registration till July 19, 2013 without paying the invoice, sending notice of cancellation by e-mail duginova@l-a.com.ua. For cancellations received after July 19, 2013, and also in case of participant’s absence on the seminar the sum of the invoice must be paid in full, a refund is not possible.
Replacements of the participants are made at any time with prior notification to the email address duginova@l-a.com.ua. By submitting an application for registration to the organizers, the participant agrees to the policy of registration cancellation and replacements.
