Alexander Bondar: There Are No Exhaustive Explanations on Uniting Medicines Into One Lot

On April 24th a webinar “Challenging Public Procurement to the Antimonopoly Committee. Practice of the Antimonopoly Committee” organized by Legal Alliance Company.

Senior associate Alexander Bondar spoke at the webinar and in his speech told about peculiarities of submitting a complaint to the Antimonopoly Committee, main requirements to its content, terms of submission and consideration, mistakes and abuses related to qualification criteria of participant selection and other typical issues which are often challenged.

“One of classical violations at medicines procurement is unreasoned uniting of products into 1 lot, which leads to numerous complaints to the Antimonopoly Committee. The Procedure for Determination of the Procurement Subject approved by Order of the Ministry of Economic Development and Trade No. 454 as of March 17th, 2016 contains only general provisions. There are no exhaustive explanations on this issue. Given the abovementioned, recommendations of the Antimonopoly Committee as of March 30th, 2018 to the Ministry of Health and the Ministry of Economic Development and Trade on preparation of general methodological explanations in order to improve determination of medicine procurement subject are extremely important”, stressed Mr. Bondar.
