Ukrainian Parliament approved in the first hearing the Draft Law № 3394 as of 02.11.2015 «On Amendments to the Law of Ukraine "On Antimonopoly Committee of Ukraine" (regarding the administrative board operation).
Previously the AMCU was able to additionally request the information within the framework of market investigation held beyond the consideration of the case of competition law infringement. In view of this, it is essential that the Draft Law № 3394 proposes to deprive the AMCU and its territorial departments of the right to request the information, which has already been provided during the current year.
With that, in order to reject the information provision it is unnecessary for the agency that received the data to be the same agency that requested it. However, the rejection is possible only if the mentioned data remains unchanged from the moment of its previous provision.
In case of the corresponding inquiry the responsible for information provision authority should submit the written rejection to the AMCU department, which requested the information, together with the indication of the reference data of the letter that previously revealed the requested information.
