Andrii Gorbatenko Participated in the Meeting of the Working Group on Improvement of Legislation Regarding Advertising of Pharmaceutical Products

On 26 August 2015 Mr. Andrii Gorbatenko, the Associate Partner of the Legal Alliance Company, participated in the meeting of the Working Group on improvement of legislation regarding advertising of pharmaceutical products.

The meeting was opened by Ms. Aleksandra Pavlenko, the Deputy Minister of Health, who presented to the members of the Working Group the research findings on approaches to regulation of pharmaceutical advertising in a number of countries including the EU Member States.

The Working Group discussed proposals on amendments to the Order of the Ministry of Health of Ukraine No. 422 "On Some Issues Regarding Prohibition of Pharmaceutical Advertising" dated 6 July 2012 which sets out the criteria for classifying pharmaceutical products as prohibited for advertising.

Apart from that, the Working Group focused on conceptual approaches to regulation of pharmaceutical advertising with regard to detecting violations and taking adequate measures for their restraint.

Moreover, the discussion concerned possibilities of assigning conduction of monitoring of pharmaceutical advertising to the Ministry of Health of Ukraine as well as including the Ministry into the list of state bodies in charge of control over advertising, in particular, pharmaceutical advertisements.

The next meeting of the Working Group will take place on 2 September 2015.
