On October 9th, 2018, the meeting “Difficulties of Translation, or Problems with Promoting Products in the Chain “Manufacturer-Distributor-Retail-Consumer” was held in Kyiv. It was organized by the Pharmaceutical Law Committee of the Ukrainian Bar Association.
At the session, Andrii Gorbatenko, partner at Legal Alliance Company and co-head of the Committee, made a journey into the history of problems of the competitive market, considered the most problematic issues focused on by the regulatory authority and emphasized importance of the AMCU recommendations provided to the Ministry of Health in September. The Ministry of Health of Ukraine must, based on the mentioned recommendations, develop and adopt regulatory act(s), which will set clear, transparent and non-discriminatory rules of medicines promotion for all participants of pharmaceutical markets which, in particular, will regulate employment of tools for medicines promotion within the whole sale chain.
“Upon the discussion it was offered to apply to the Ministry of Health on behalf of the association on the matter of determination of criteria for proper competitive conduct with respect to promotion of medicines in the sale chain, in particular, in pharmacies. Application of such criteria will allow good-faith participants of the market to support the competitive environment by themselves. Besides, the Committee is ready to cooperate with the Ministry of Health to provide professional support regarding development of the mentioned project”, Andrii Gorbatenko stressed.
