In early October 2017, investigators of the National Police of Ukraine held a search upon which weapons and their components belonging to the person based on corresponding permits were illegally seized. Also, during the search the investigator committed a crime provided by Article 397 of the Criminal Code of Ukraine – creating obstacles for legal activities of the attorney.
Legal Alliance team appealed to Golosiivskyi District Court of Kyiv with the corresponding complaints, upon consideration of which the investigating judge delivered a ruling on returning the mentioned objects to their legal owner.
Since the abovementioned rulings were not enforced, attorneys of Legal Alliance Company filed applications on the crime committed by the investigator, namely one specified in Article 382 of the Criminal Code of Ukraine – non-enforcement of a court decision.
Almost half a year after the search, upon 3 criminal proceedings for investigator’s non-enforcement of the court decision, the weapons were returned to the legal owner.
The client in this case was represented by Taras Bezpalyi, attorney and counsel at Legal Alliance Company.
