On April, 7 this year the second expert working party meeting on the pharmaceutical market deregulation, established by the Ministry of Healthcare of Ukraine, was held.
Aleksandra Pavlenko, the vice minister of the Ministry of Healthcare, and Igor Peregynets, the deputy of the minister of the Ministry of Healthcare were participants of this event. Also experts of the public enterprise “The State Expert Center of the Ministry of Healthcare of Ukraine” (hereafter referred as to SEC), representatives of national and foreign medicinal product producers, pharmaceutical associations presenting producers’, distributors’ interests and interests of pharmacy companies, lawyers and representatives of American project “Systems for Improved Access to Pharmaceuticals and Services Program” (SIAPS) take part in the discussion on changes in legal acts.
Among other questions, the draft of amendments to the Order of the Cabinet of Ministers of Ukraine N 240 on referential pricing for medicinal products and medical devices was considered.
The draft was presented by Dmytro Aleshko, Partner at Legal Alliance Company. As he said, with the help of the Ministry of Healthcare the meeting was organized and consultations with the specialists of the Ministry of economic development and trade of Ukraine were conducted. These specialists argued against the possibility of wholesale price change declaring in the foreign currency with its transfer by the rate of the National Bank of Ukraine at the date of contract, proposed by the draft of the CMU. To find the compromise, specialists of the Ministry of economic development and trade of Ukraine propose to apply the model used in gas market. The special commission once a month provides price re-calculation by itself and publishes this re-calculation. Based on provisions of relevant government order, amendments to the draft of the CMU were adopted. “This clause means that if the rate of US dollar will change more than for 5 %, the Ministry of Healthcare automatically provides re-calculation maximum price range and relevantly changes the register of wholesale prices of medicinal products and medical devices” – Dmytro Aleshko commented proposed amendments.
Further to discussion on the draft of amendments to the Order of the Cabinet of Ministers of Ukraine N 240 the participants decided to submit this draft for compliance to the state authorities as the reaction on crisis situation. Moreover, at the same time the participants of event will work on the document improvement.
The event focused on the transformation of Ukraine's intellectual property sector on its path toward European integration.
