On May 27th, 2017 near the Kyiv City State Administration there was rally held to draw attention of public authorities to the problem of illegal construction in the centre of Kyiv, which threatens preservation of a historical monument.
At acquisition of a land plot at Kruglouniversitetska Street, provisions of state building codes and current legislation were not taken into consideration. It was not taken into account that construction impedes free passage of fire and other specialized machines, as well as the fact that the security zone of heating networks and the local sewerage, which as a result of the construction work was already damaged, pass through this area.
Given the obvious violations of the legislation both by the developer companies and the Kyiv City Council at acquisition of the land plot for construction and maintenance of a shopping mall at Kruglouniversitetska Street, the prosecutor of Kyiv filed a lawsuit on invalidation of Kyiv City Council decision and invalidation of the land sale contract and state land ownership certificate.
At the moment, the case is pending before the Kyiv Commercial Court of Appeal, where Illya Kostin, partner and attorney-at-law at Legal Alliance company, and Roman Tytykalo, a deputy of the Kyiv Region Council, are representing interests of local residents pro-bono.
Ilya Kostin commented on participation in the cultural heritage protection project at Kruglouniversitetska Street as follows, "Lawyers are obliged to support the public and offer a reliable legal position to preserve the heritage of our city. Nothing is impossible for those who advocate a just case. An inspiring example of this is the discontinued construction at Telbin Lake, on the territory of which for now a beautiful area for leisure and recreation of people has been created".
