December 10, 2014 Legal Alliance Company together with a specialized consulting agency "Pharma Staff" held a seminar "Novels HR: dismissal of authorities, liability for damage, leave for childcare"
The speakers of the event were partner and head of tax law department of Legal Alliance Company Anatolii Menshikov and director of specialized consulting agency "Pharma Staff" Andrew Anuchin.
The participants of event were accountants, hr-managers and lawyers of pharmaceutical companies.
The seminar researched new grounds for dismissal authorities of companies, liability for damage: changes in Labor Code (the Law #1255), some changes on leave for childcare from 01.07.2014 (according to the Law №1166) and analysed the situation in the labor market in Ukrainian pharmacy prior to 2015.
As Anatolii Menshikov said, on June 1, 2014 The Law of Ukraine "On Amendments to certain legislative acts of Ukraine regarding investor protection" (dated 13.05.2014 №1255 – VII). The above said statute established significant changes in the number of articles of Labor Code of Ukraine concerning the termination of employment relations, severance pay in the event of termination of employment relations, as well as the amount of liability for damages conferred on authorities.
For example, the Article 41 of Labor Code of Ukraine was supplemented with paragraph 5, which establishes the right of the owner or the authorized body to terminate the employment contract with authorities due to termination of their powers.
According to the amendments of the Article of 44of the Labor Code of Ukraine, expenses in view of the termination of the authorities were reduced. In the case of termination under the paragraph 5 of the Article 41 of Labor Code of Ukraine, such person shall be paid severance pay of six months average salaries at least.
"It should be noted that the severance pay of six months average salaries at least is guaranteed minimum. Severance pay shall not be less, but it may be larger. The higher severance pay may be fixed in the employee’s employment contract. Taking into account the innovations of Labor Code of Ukraine, statutes of economic entities should be properly modified and supplemented in issues relating to the practical implementation of the provisions of paragraph 5 of the Article 41 and Article 44 of Labor Code of Ukraine "- said Mr. Menshikov.
In turn, Andrii Anuchin told participants of seminar about changes in the labor market and salaries of employees in the last six months of 2014, identified the main measures, which were used / are used by pharmaceutical companies for protection of the salaries against devaluation and predicted the planned increase in staff in pharmaceutical companies in 2015.
The event focused on the transformation of Ukraine's intellectual property sector on its path toward European integration.
