Legal Alliance Company asserted interests of Ukrainian football club of premier league by deciding of issues on ensuring of the suits by courts

In July Legal Alliance Company asserted interests of the client - Ukrainian football club, by deciding of issues on ensuring of the suit, in form of arrest of property and prohibition for the owners to command corporate rights, by courts.

Borispol city district court satisfied a statement on ensuring of suit in corpore, that brought to arrest of all client’s realty and debarring the participants from commanding corporate rights. Economic court of Kiev region partly satisfied the similar statement and denied arrest only.

However, lawyers of Legal Alliance Company appealed the mentioned decision on the bases of the fact that issues on ensuring of the suit are not commensurate and connected with requirements of the suit, and application of them would not guarantee execution of court decision or effective protection of complainants’ rights.

Суды апелляционной инстанции и Кассационный суд в составе Верховного суда солидарны с позицией Правового Альянса и пришли к единодушному выводу об отсутствии оснований для применения мер обеспечения иска. Courts of appeals instance and Court of cassation on Supreme Court are solidary with the position of Legal Alliance Company and came to the unanimous conclusion on absence of reasons for making arrangements for suit ensuring.
