On October 24, 2014 a senior associate with LC "Legal Alliance" Vitalii Savchuk held a webinar for the pharmaceutical companies on the topic "Protection of intellectual property of your company in 2014-2015. The review of cases".
During the webinar the main problems, faced by the company's clients in intellectual property for the last twelve months, were explained. The speaker, in particular, focused on the issues of how third parties can assign the trademark of best-selling medicine, and how to avoid it, talked about what bad is in bilingual trademarks, where to start a protection of the technology, which has already received a patent, and also highlighted the rules of fighting patent trolls in design (industrial design).
"Our company has come across cases of patent trolling by the owners of patents, whose utility models or industrial designs (designs) are lacking of novelty, but, nevertheless, are registered. The purpose of such registration may be either hindering the import of medicines of other actors (most common for industrial designs) or impeding the realization of competitors’ medicines in the domestic market (more common for utility models)" - said Vitalii.
The speaker also discussed with the audience the basic mistakes that make companies, which had already obtained titles of protection for patents, trademarks, etc., but still were not able to protect these items from violations, told about what such errors can cost to companies, as well as answered to practical questions of the webinar participants.
The event focused on the transformation of Ukraine's intellectual property sector on its path toward European integration.
