Law Firm “Legal Alliance” represents one of the nation's leading pharmaceutical distributors in the case instituted by the Antimonopoly Committee of Ukraine on the basis of anticompetitive concerted actions relating to the supply of medicinal products.
It is known that based on the results of the pharmaceutical market research carried out by the ACU bodies, the Committee commenced the proceedings in six cases of anticompetitive concerted actions relating to the supply of medicinal products at the national level.
As the Committee established, the schemes of unjustified increase of prices for medicines due to the contract restrictions, as well as the use of discounts, bonuses and other financial incentives were applied in the relationship between individual foreign drug manufacturers and national distributors.
According to the Committee’s estimate, the prices at which foreign-made drugs are sold to importers and distributors are in some cases twice as high as the actual price of the goods at which it is delivered to a dealer.
