Military registration of the employer

On January 3rd, 2023 the new Rules of organization and maintenance of military records of conscripted soldiers, persons liable for military service and reservists were adopted by the decree of the Cabinet of Ministers of Ukraine No.1487 dated December 30th, 2022.

The government specified the obligations of businesses regarding the maintenance of the military records of the employees. The Rules also established the nuances of the employment of women that hold a degree in medicine and pharmaceutics — from now on, the registration at work will not be required until the end of 2026. Regarding the general military registration for such women, there are no changes yet.

The Employers received quite a detailed procedure on engagement with employees and authorized bodies concerning the military registration, in particular, on:

  • Keeping and annual approval of personal military records of the employees, which implies the collection of their personal data and any changes in such.
  • Obligation of the employer to adopt new rules of the military registration and familiarize employees with them.
  • Submission of lists of employees that ought to be registered in the enlistment offices.
  • Submission of records on employment, dismissal of the employees, as well as on changes in their records to the corresponding state bodies.
  • Notification of the employees on their notice to show up at the recruitment centers.
  • Appointment of the authorized employee (has to be a part of staff) responsible for the reconciliation of data according to the approved schedules.
  • The process of the audit of maintenance of records conduction by the state bodies.

The precise terms are established for each of the stated procedures.

Same as before, the violation of the new Rules may result in administrative fines for the management of the employer. However, the chances of imposing sanctions are much higher as now more obligations were assigned to the employers.
