Information regarding results of hearing and voting for draft Law “On conducting state purchases”, registered under number 4587 of March 27th, 2014, was published on official web-portal of Verhovna Rada of Ukraine on April 10th, 2014. Initiator of the Draft Law was Prime-Minister of Ukraine A.P. Yatsenyuk.
Minimally requested quantity of deputies of Ukraine for respectful decision (226) voted for adoption the draft law in principle and in whole. Under Closing and Transitional provisions of the Law enters into force from date of its promulgation.
It shall be noted that Law is treated as that aimed at liquidation of corruption, elimination of discriminative, as for international operators of pharmaceutical market, qualification requirement regarding obtaining of own production facilities and/or service centers in the territory of Ukraine by a participant.
In addition, it removes such procedure related to purchases as electronic reverse auction, partly amends terminology (in particular, procedure related to purchase form one participant shall be called negotiation procedure of purchase) and scope of the Law also embraces instances of goods, work and services purchases by state and municipal legal entities for own monetary assets.
Within defining of the main amendments it shall be also stated that according to the Law non-governmental monitoring under procedures of state purchases increases as well as opportunities to litigate the procedures that do not comply with principle of rule of law.
Procedure of goods, works and services purchases that have been started before the date whereon the Law entered into force shall be finalized according to the order which was effective before the date whereon the Law entered into force, but not longer than within three months.
