Non-residents: work and residence permits in Ukraine under martial law

The imposition of martial law in Ukraine has led to changes in current legislation. They are largely related to the simplification of procedures and extension of deadlines for certain actions. However, not all areas have undergone such an update.

Thus, despite the imposition of martial law, the validity of (1) work permits for foreigners and (2) residence permits in Ukraine continue to operate normally without any changes.

Taking into account the peculiarities of conducting the pharmaceutical business in Ukraine – attracting foreigners for top management positions – it is necessary to timely monitor the expiration date of such documents.

Currently, there are no official reports of such documents being automatically extended by the authorities. If the permit expires during martial law, there are risks of sanctions being imposed on both employers and employed non-residents. The amount of such fines reaches 130 thousand hryvnias.

To avoid any negative consequences, we recommend that you prepare in advance for the submission of the necessary documents, given the difficulties in the logistics of delivery of documents and the limited work of the authorities.

If you have any questions about the procedures for extending permits or obtaining new ones, as well as about fulfilling the tax obligations of non-residents of Ukraine, the team of Legal Alliance law firm is ready to provide the necessary clarifications and legal advice.
