​Presidential Decree on the notarial acts

Recently, Volodymyr Zelensky has cancelled by his Decree fully or partially about 191 decrees of previous presidents. Such a vigorous activity of the President of Ukraine was presented by the Administration as another promised step on deregulation. Putting emotions aside, a closer look shows that these decrees, in most cases, relate to administrative and economic issues and are virtually inactive or just duplicate other regulatory acts.

The abolition of the requirements for the minimum fee for notarial services of private notaries was particularly emphasized (Decree of the President of Ukraine No. 762/98 dated 10 July 1998 “On Arrangement of Collection of Fees for Notarial Acts”). However, notaries in their activities and operations use another regulatory act, namely the Procedure for the Performance of Notarial Acts by Notaries of Ukraine, approved by the order of the Ministry of Justice of Ukraine. This order inherently duplicates the provisions of the abolished Presidential Decree. That means, in terms of the fee for notarial services nothing has been changed, as the Notary Chamber of Ukraine has already declared on its website.
