Two Resolutions in the sphere of public procurements of medicinal products and medical devices were placed on the website of the Cabinet of Ministers of Ukraine (CMU):
According to the Resolution of CMU № 559, such criterion as the product price was excluded from the list of criteria for selection of the specialized international organizations for performing the centralized procurements of medicinal products and medical devices. In practice, the information on the price of the products may not be basically available during the process of the specialized organizations selection. At the same time, the price for the services related to the products procurements remains one of the criteria for the organizations selection.
No other changes were introduced into the criteria for international specialized organizations selection.
Besides, due to the fact that the Law of Ukraine On State Procurements № 1197-VII has ceased to be in force, the respective reference to this Law was replaced with the reference to the Law of Ukraine On Public Procurements № 922-VIII.
According to the Resolution of CMU № 560 some amendments were made to the Resolution of CMU № 787 dated 08.10.2015.
In particular, the Ministry of Health of Ukraine was granted the possibility to increase the quantity of products to be purchased within the savings based on the results of the procurements in 2015 but no more than 100% of the needs.
At the same time, the issue of deviation from the quantity of medicinal products in order to bring them into accordance with manufacturer’s package is not expressly regulated.
