On July 4, 2017, the government adopted resolution "On Amendments to Cabinet of Ministers Decree No. 333 of March 25, 2009", the draft of which is posted on the official website of the Ministry of Health of Ukraine for public discussion.
The document provides for postponing the date from which health institutions funded from state and local budgets should launch government purchases of medicines registered in Ukraine and included in the National List of Essential Medicines until September 1, 2017.
In addition, the draft decree of Cabinet of Ministers of Ukraine provides for postponing the enactment of the provision on the obligation of customers to pre-satisfy in full the requirements for medicines registered in Ukraine and included in the National List of Essential Medicines until January 1, 2018.
Let us remind you that according to decree of the Cabinet of Ministers of March 16, 2017, No. 180, the Cabinet of Ministers decree No. 1071 of 05.09.1996, which approved the list of medicines of domestic and foreign production that can be purchased by agencies and health care institutions, fully or partially funded from the state and local budgets, expires on July 1, 2017.
Taking into account the current situation and with the aim of completing all tender procedures by the customers, the CMU draft resolution directly provides that the procedures for the purchase of medicines registered in Ukraine and listed in the State Register of Medicines launched by the customers by September 1, 2017, shall be completed in accordance with the procedure and requirements, which are in force until this date.
Natalia Spivak, Legal Alliance Company associate, emphasizes that the document also provides for the correction of technical mistakes in the text of the National List of Essential Medicines, as well as review of the release forms and effects of certain medicines to bring it in line with the Cabinet of Ministers Decree of 9 November 2016 No. 863 "On the introduction of reimbursement of the medicines cost" (the state program "Available medicines").
As of July 5, the document has not entered into force. The final text of the resolution of the CMU will be available for review after its official publication.
