The High Council of Ukraine has Proposed that Territorial Offices of The Antimonopoly Committee of Ukraine Be Vested with the Right to Provide Conclusions in the Form of Non-Binding Recommendations

The High Council of Ukraine has given the approval in principle to the Draft Law of Ukraine No. 2244 dated 26 February 2015 "On Amendment to Certain Legislative Acts of Ukraine (as regards improving the legislation on protection of economic competition between business entities).

The Draft Law envisages vesting state commissioners, territorial offices, the administrative collegium of the Committee and the Antimonopoly Committee as the highest collegial body with the right to provide conclusions in the form of recommendation clarifications concerning compliance of activities performed by the business entities with the provisions of Arts. 6, 10, 13 of the Law of Ukraine "On Protection of Economic Competition" and Art. 15-1 of the Law of Ukraine "On Protection against Unfair Competition".

So far, the right to provide recommendation clarifications regarding application of the legislation on protection of economic competition has been the privilege of the Antimonopoly Committee of Ukraine.

Adoption of the aforementioned amendments shall afford business entities an opportunity to obtain conclusions in the form of recommendation clarifications as regards the compliance of their activities with the legislative provisions on protection of economic competition directly at the place of their seat, i.e. in the relevant territorial offices of the Antimonopoly Committee of Ukraine.
