The State Service of Ukraine On Food Safety and Consumer Protection is Ready to Function

On 12 September 2015 the Resolution of the Cabinet of Ministers of Ukraine No. 667 which approves the Regulation on State Service of Ukraine on Food Safety and Consumer Protection dated 2 September 2015 came into legal force.

The newly created State Service of Ukraine on Food Safety and Consumer Protection was established through reorganization of State Veterinary and Phytosanitary Service by combining it with the State Inspection of Ukraine on Consumer Rights Protection and the State Sanitary and Epidemiological Service of Ukraine.

As a result, the State Service of Ukraine on Food Safety and Consumer Protection has now become the central body of executive authority, main tasks of which include the following:

State control of compliance with consumer protection legislation;
State control of compliance with advertising legislation as regards protecting consumers of advertising (the State Service of Ukraine on Food Safety and Consumer Protection takes decisions that find the advertisement unfair or surreptitious , or decisions that render comparison in the advertisement unlawful and simultaneously suspend its dissemination);
State control of compliance with requirements on formation, establishment and application of state regulated prices (in particular, the State Service of Ukraine on Food Safety and Consumer Protection supervises compliance with requirements on formation, establishment and application of state regulated prices as well as exercises control over the accuracy of information indicated in the documents pertinent to formation, establishment and application of state regulated prices);
State veterinary-sanitary control;
State control over application of phytosanitary measures;
State control of compliance with legislation on veterinary preparations;
Conduction of state expert sanitary epidemiological assessment, provision of relevant conclusions based on its results etc.

Real levers of control were provided to the State Service of Ukraine on Food Safety and Consumer Protection in view of enabling the latter to perform tasks entrusted upon it and counteract legislative infringements. As per the Regulation, the State Service of Ukraine on Food Safety and Consumer Protection is vested with the following authorities:

To have unhindered access to production facilities and other objects of state supervision (control);
To obtain information, documents, and materials required to perform tasks and functions entrusted upon it as well as for the purposes of planning activities related to state control from state bodies and bodies of local self-government, enterprises, establishments, organizations notwithstanding their type of incorporation, the officials employed with such organizations and also from citizens and non-governmental organizations free of charge.
To restrict, prohibit, suspend activities, take other response measures in compliance with the law including restriction or ban on import (transfer) into the customs territory of Ukraine or movement (transit) through the customs territory of Ukraine of live animals, reproduction material, pathological material, feeding stuffs, veterinary medicines, animal care products, inedible products of animal origin and food products;
To request that business entities eliminate detected infringements in compliance with the law;
To undertake measures on eliminating legislative infringements within its legally established competence and on holding the persons having committed such infringements accountable in line with applicable law.

To note, in accordance with existing legislation, the State Service also acts as licensing body for veterinary medicine practice.
