On April 27th, 2017 a team of Employment & Labor Law Practice of Legal Alliance Company successfully won a case for a leading pharmaceutical company involving a labor dispute with an employee, who also claimed moral damages.
The cause of the trial was wrongful, according to the plaintiff, dismissal, which occurred in February 2017 due to lay-off. The plaintiff argued that the company did not adhere to the provisions of labor legislation, did not take into account the high productivity of his work and higher qualification compared to other employees. Guided by these arguments, the plaintiff submitted a demand for reinstatement at work, payment of average monthly earnings for the period of forced absence and compensation of moral damage in the amount of UAH 400,000.
The hearings in the Pechersk District Court of Kyiv were held in several sessions. Lawyers of Legal Alliance gave legal advice on the dismissal of the plaintiff, having previously developed a legal position, as well as prepared necessary documents to justify the position. Despite the contradictory case file and the plaintiff's claim, based on the results of a comprehensive investigation of the circumstances and file of the case, Pechersk District Court of Kyiv at the last session supported position of the pharmaceutical company and completely dismissed the plaintiff's claims to the former employer for reinstatement at work, payment of average monthly earnings for forced absence and compensation for moral damage.
