In August 2017, the Prosecutor’s Office of Kiev region served on a client of Legal Alliance Company, deputy of Kiev Region Council, a notice of suspicion of crime specified in Article 364(2) of the Criminal Code of Ukraine – abuse of power of office. According to the Prosecutor’s Office, our client, being a district administration head, signed a number of orders under which he seized land from a state-owned enterprise and transferred it illegally to individuals in their private ownership. Such actions caused damage to the state in the amount of UAH 39 million.
Attorneys of Legal Alliance Company developed and implemented defence strategy which finally led to the prosecutor’s delivering a ruling on closing the proceedings against our client at the pre-trial stage.
With respect to results of the defence actions, it should be noted that initially the prosecutor’s office requested for a restriction measure in the form of arrest or bail in the amount of UAH 39 million, however, court of the first instance decided on bail in the amount of UAH 4 million, and the appeal instance changed the restriction measure into personal guarantee of a people’s deputy of Ukraine and later, at the sanction prolongation, Pecherskyi Court of Kiev cancelled the restriction measure at all.
The defence attorneys managed to detect a number of violations of the investigation prosecutor’s office, due to which investigators and prosecutors were challenged. Also, advocates collected evidence of the client’s innocence.
Upon the pre-trial investigation and expiry of its final term (12 months), the prosecutor’s office delivered a ruling on closing the proceedings against the client due to lack of crime in his actions.
