"Legal Alliance" intellectual property team succeeded in the litigation on domain dispute defending the interests of an international manufacturer of cosmetics.
The difficulty of this project lies in the ambiguity of judicial practice on cases regarding domain disputes. The legislative regulation of such disputes in Ukraine is quite limited. This creates significant difficulties for honest plaintiffs in the enforcement of their rights. In particular, such aspects as the re-delegation of domain name in the favor of new owner and the discharge of domain name registration are not regulated by the law at all. This leads to the ambiguity of judicial practice.
Nevertheless, Legal Alliance team succeeded in prompt determination of the domain name owner, who infringed the Client’s trade mark, and achieved an injunctive relief in the form of the prohibition of any changes to the registration data and of the re-delegation of the disputed domain name in the course of litigation.
Within the course of the project the parties held the negotiations that led to the settlement agreement. The Client obtained the domain name much faster than it happens in such category of cases.
