Kyiv Court of Appeal by its decision as of June 22nd, 2017 supported legal position of Legal Alliance labour law practice associates who represented one of the leading pharmaceutical companies in a labour dispute with its employee. The company’s opponent claimed moral damages in the amount of UAH 400,000.
The reason for proceedings was unfair, according to the claimant, dismissal which took place in February 2017 due to redundancy. The claimant grounded his complaint by the fact that the company had not observed labour legislation, had not consider his high labour performance and higher qualification compared to other employees. Guided by these arguments, the claimant requested reinstatement, payment of monthly salary for the period of forced absence form work and significant moral damages.
The first instance court refused to satisfy the claim, however, the claimant appealed the court’s opinion.
Experts of Legal Alliance Company prepared grounded defences to the claimant’s appeal and represented the pharmacological company in the court of appeal.
Finally, the court of appeal did not satisfy the appeal upholding the first instance court’s decision.
