Legal Alliance attorneys-at-law successfully defended the interests of the Client, being one of the leaders of private medical services providers, in the litigation regarding moral and material damage recovery.
In two years after the provision of medical services the client applied to the court for the recovery of more than UAH 300 000 of moral and material damage. The plaintiff's claim was based on the assumption of inefficient and incomplete medical services provision.
The defendants’ position was based on the incorrect notification of the doctor by the patient on the complaints and recommendations of previously visited doctors, as well as the absence of a causal link between the actions of the doctor and patient.
Having analyzed all case materials, explanations of the parties and evidences, Darnytsya district court made a decision on September 6, in which the plaintiff’s claim was denied by confirming the adequate provision of medical services to the patient and the inappropriateness of the claim.
