Legal Alliance Company presented interests of Association of International Pharmaceutical Manufactures (AIPM Ukraine) in the case on unfair competitive actions of LLC “General agency “PRO-PHARMA” during TV-advertising of medicinal product “Pancreasim”.
This case proceeding was initiated by Kyiv local territorial department of Antimonopoly Committee of Ukraine due to violation of legislation on protection against unfair competition (in particular, sharing of mislead information) during advertising of medicinal product “Pancreasim” and has gone on for year.
As it was proved during proceeding, within extended period the advertising of medicinal product “Pancreasim” was shared by TV and it claimed: “Only for 15 minutes Pancreasim annul abdomen heaviness”, “Pancreasim. From heaviness to lightness for 15 minutes”, but such statements were not truthful, misled consumers and gave the opportunity for violator to get advantage in the competition.
The Temporary Administrative Panel of the Antimonopoly Committee of Ukraine imposed a fine at the amount of 700 000 UAH to LLC “General agency “PRO-PHARMA” for unfair action in the competition.
For the history of Antimonopoly Committee of Ukraine this fine is third largest for unfair competition on pharmaceutical market.
