In October of this year Legal Alliance team successfully represented the interests of the distributor of medical devices for hemodialysis in the litigation regarding the recovery of penalty for the undelivered products.
The case aroused from the rejection by non-resident manufacturer of all requests of the Client for the supply of medical devices and complete termination of their supply to the territory of Ukraine. This led to the Client’s fail in the fulfillment of delivery obligations that resulted in penalty sanctions and further litigations initiated by the Client’s contractor in Ukraine.
However, on October 25 of this year, the Commercial Court of Kyiv having considered all collected evidences and studied all contractual relations between the parties to the case, ruled on the entire rejection of the plaintiffs claim.
