Legal Alliance continues sharing the situation around the project on the protection of Kyiv lake Telbin against illegal constructions. Our attorneys extend their pro bono support to the civil movement for the lakes’ protection since 2011.
It is worth to mention that LLC «Aquapark» planned to construct the illegal residential-hotel complex on the west bank of the lake. The plan of the construction contradicted the applicable legal regulations, i.e. environmental protection, land, water, construction development laws and public services and utilities legislation. Nevertheless, the issued permission for the construction stipulated the destruction of the entire recreation site of Bereznyaky residential area in Kyiv. Non-indifferent inhabitants of Bereznyaky residential area consolidated around this issue.
Within four years the group of Bereznyaky residential area activists, members of population self-organization bodies and lawyers fought against the illegal construction works around lake Telbin. A great number of administrative and court actions have been taken which finally gave the results.
Thus, the attorneys-at-law from Legal Alliance applied on behalf of population self-organization body «Committee of «Bereznyaky-Telbin» Residential Area» with the attorneys request to Kyiv Council and Kyiv Mayor Vitaly Klitschko regarding the organization of park recreation site and the termination of residential complex being constructed by LLC «Aquapark».
In reply, Land Resources Department of Kyiv State Administration informed that on July 23, 2015 Kyiv Council made a decision on the termination of land lease agreements concluded between Kyiv Council and LLC «Aquapark», permission for this land plot division and incorporation and permission for land project development regarding the allocation of the land plots at Yuriy Shumsky Street in Dniprovsky District of Kyiv for recreation site construction, in particular a park named after Viktor Tsoi. The letter was accompanied by the copies of confirmation documents, in particular of the abovementioned decision of Kyiv Council and different scheme-plans.
In such a way, the community of Bereznyaky achieved its ultimate goal and reached the termination of illegal construction works on the lake Telbin. In return the citizens will have a cozy park and the place for leisure time and relaxation.
We convey to Bereznyaky residents our congratulations with this victory over a long and uneasy dispute. We are proud of the self-consciousness revealed by each community member for the common cause.
