Yulia Vykhrovska: Currently, There Is No Bill Or Another Regulatory Act Introducing Quotas For Employees Over 45 years Old

Hardly had employers managed to cope with the legislatively quoted employment of disabled people, when the government decided to take care of another preferential category - mature candidates. Let us leave for them the question why instead of the positive motivation of employers the quota whip has again been chosen: let us think about how to live on.

Currently there is no bill or another regulatory act introducing quotas for workers over 45 years old. At the same time, according to the widespread information in the media, quotas should be in effect from January 1st, 2018.

It should be noted that from January 1st, 2018, the norm of Law of Ukraine "On Amendments to Certain Legislative Acts of Ukraine Regarding Increasing Pensions" No. 2148-VIII, which establishes another quota for enterprises, institutions and organizations with 8 to 20 employees, comes into force. This Law prescribes the following quota: a quota of at least one place to employ a person who lacks 10 or fewer years to retire. Other companies, in particular those with more than 20 employees, are not required to allocate such quotas.

The corresponding changes were made Article 14(2) of the Law of Ukraine "On Employment of the Population".

According to Article 53(1) of this Law, if the employer fails to provide the employment quota for employment during the year, a fine is imposed for each unjustified refusal to employ such persons as provided by the respective quota. The amount of the fine is two minimum wages established at the time of the violation. That is, the fine is UAH 6,400.
