June 23, 2015 on the official web-site of Verkhovna Rada of UkraineDraft Law of Ukraine “On amendments to some Laws of Ukraine on selling of medicinal products” no. 2147a of 23.06.2015 was registered.
According to this Draft, it is proposed to reduce the list of subjects entitled to retail trade of medicinal products in the countryside, where there are no pharmacies or pharmaceutical points. Thus, under this case trade has to be carried out through medical assistant and medical assistant and obstetric station.
It should be noted that the current procedure of retail trade of medicinal products in the countryside where there are no pharmacies or pharmaceutical stations regulated to theLicense Conditions for the medicinal products production, wholesale and retail trade of medicinal products. However, this document stipulate much wider list of subjects entitled to trade. In particular, the retail trade is carried out in premises medical assistant and medical assistant and obstetric station., rural, district hospital, ambulance station, ambulance of general practice and family medicine by employees of these institutions with medical education under the contracts concluded with the licensee who obtains the license on retail trade of medicinal products.
Nevertheless, the Draft does not provide amendments to the License Conditions. Taking into account primary legal force of the law to the order of the ministry, provided that the Draft is adopted, it will have precedence over the regulations of the License Conditions.
Consequently, the proposed initiative does not take into account the current legislation and instead of simplification the opportunities dispensing the medicinal products to the citizens, creates legal uncertainty and practical difficulties for the medicinal products supplying to the citizens.
