On April 21st, 2017 the VIII annual event in the field of personnel legislation and management “VIII All-Ukrainian Personnel Meeting” organized by MEDIA-PRO company was held in Kiev.
The event was attended by more than 200 HR-leaders of leading companies, lawyers and representatives of public authorities. VIII All-Ukrainian Personnel Meeting allowed the participants to discuss topical issues of labor law and innovations in labor legislation with leading professionals in this area, share their experience in settling labor disputes and analyze the peculiarities of labor policy, document management and much more.
Legal Alliance Company was represented by Illya Kostin, partner, who heads the practice of the Company's labor law. Mr. Kostin made a presentation on the topic “Dismissal of the Management Team. What the Owner Should Be Ready For”.
In the course of his speech Illya Kostin emphasized on the topical challenges and issues which an owner of a company will have to face at the dismissal of senior management. Among them there are such issues such as dismissal procedure, arrangement for case transfer, action planning, notification of employees, signing documents, possibility of amicable settlement.
Among the main problems at the dismissal of senior management, he noted the unclear terms of the contract, complexity or suspension of the new leadership's inauguration, familiarization with the criminal law, moral burdens and restriction or suspension of economic activities, interaction with the State Service of Ukraine for Labor, etc.
As a way to avoid conflict, Illya Kostin recommended to keep confidentiality, prepare information for the staff and contractors in advance and notify them accordingly, and also have a B-plan / documents, even if involuntary dismissal is not planned.
“The main goal is to reach an agreement. This is not a war - so do your work or give it to others”- Illya Kostin summed up.
